Who is taking the initiative?

Here is an interesting request I received and I am delighted at the scope of mediation possibilites that it holds.

A friend who reads my posts on mediation regularly on Facebook asked me to help with creating a Joint Family Agreement. Just that it was not as simple as it appears.



This is the backdrop.

They are a huge group of 14 cousins of 2 brothers and 2 sisters all are senior citizens now.

Their parents owned several properties in India which needed a proper division amongst the children. The properties included buildings, Cinema halls, Petrol Bunks, Palatial Bungalows, Jewellery, Cash, Farms, Deposits in Banks and Agricultural property in Villages.

The cousins were putting the matter away due to several reasons.

- All are scattered in various parts of the planet.

- All are well settled and none of them need the properties.

- All wanted to retain it for legacy and sentiment sake.

- They owed it to their children that they retained the family properties.

- They had to take care of these inheritances for the roots that bound them together.

- They shared a good bond but apprehensive that the properties have issues and old parental conflicts tied to them.

They did not want to visit the negatives attached with the legacy.

- The Crucial question was who will bell the cat?

Only one thing was clear and that was that they wanted to stay out of courts.

One of the cousins decided to take matters in hand. She stays in Australia and the properties were all in one city in India.

What did we do next?

How did this end?

Did it end at all?

Was any conclusion reached?

Did the cousins agree?

How did they meet?

Most importantly, what did the mediator do?

Any thoughts? What would you do?

A family is more than a perfect picture. The layers of conflicts simmer beneath the relationships. When families communicate and mutual respect and understanding prevail they sail through tough situations as a unit.
Learning to resolve a conflict is sometimes natural to an individual and very often it can be learned.
How to navigate through tough situations through smart use of vocabulary is what is gained when one learns to mediate.

The training helps build self-confidence in individuals that makes them take risks as well.
