Moi University invites applications from qualified candidates for its inaugural Master of Laws (LL.M.)
degree programme in Child and Family Law. The programme commences in January 2014, and is
offered in the Department of Private Law, Town Campus Annex, Eldoret. Taken over four semesters,
the programme offers a specialist curriculum in this field, comprising of coursework, advanced clinical
attachments and the Master of Laws degree thesis.
Family law, succession and child law are increasingly accorded a prominent place in most undergraduate
law curricula and in the national legal system. These courses are specifically indicated as mandatory
components of the Bachelor of Laws degree curriculum by the Council of Legal Education. The
Constitution of Kenya 2010 recognises the importance of legal protection of the institution of the
family and contains provisions regarding cultural rights, family rights, and, the welfare and rights of
children and young persons. In the Judiciary, Children’s Courts have been established by statute to
facilitate the resolution of civil and criminal matters relating to children, while a specialised Family
Division of the High Court has been created to adjudicate matters relating to family law and succession.
Kenya has ratified various international and regional conventions on the rights of the child as well as
human rights treaties that recognise family rights. Participation in global human rights regimes, the
emerging national trends in marriage, cohabitation, child-bearing and the economic consequences of
family breakdown demand principled and informed interrogation and review of the relevant national
practices, policies and laws. In view of these developments, our programme is tailored to meet the
need for advanced postgraduate degree training in child and family law, and to contribute to capacity
building through equipping and mandating appropriately skilled experts in this very important field.
Minimum admission requirements
a. Holders of a Bachelor of Laws, First Class Honours or Second class Honours Upper Division degree
of Moi University or its equivalent awarded by a recognised and accredited university;
b. Holders of a Bachelor of Laws, Second Class Honours Lower Division degree of Moi University or its
equivalent awarded by a recognised and accredited university, with two (2 ) years’ relevant work
experience in Child and Family Law.
The programme is designed to provide academic and professional skills training for lawyers seeking
to advance careers in child and family law. It is especially suitable for scholars intending to conduct
research and teaching child and family law courses in university law schools, specialist practitioners
at the Bar and Bench as well as independent researchers, civil society officials, consultants and policy
advisors in the field of Child and Family Law. Commitment and motivation to conduct independent
academic study in this field will be required of all candidates.
