The Advocacy Institute is a non-profit, tax-exempt organization dedicated to the development of products, projects and services that work to improve the lives of people with disabilities.

Projects include the Advocate Academy,a Webinar service designed to meet the training needs of special education advocates nationwide by providing on-going training and professional development, Advocacy in Action, providing key findings from important research in special education, Our Kids Count, a project focused on preserving key requirements of the No Child Left Behind Act (NCLB) in the upcoming reauthorization of the Act, and IDEA Money Watch, tracking the use of more than $11 billion to support special education services for the nation's students with disabilities (IDEA Part B), as part of the American Recovery and Reinvestment Act (ARRA) passed in February 2009.

The US Dept. of ED has posted letters sent to 14 States that exceeded the 1% threshold on alternate assessments in the 2017-18 school year without a waiver. The states are CA, CO, CT, FL, HI, IL, KS, MD, MN, NJ, NY, OR, PA, and VA. The letters are posted on the page at https://www2.ed.gov/policy/elsec/guid/stateletters/index.html , under the heading “Alternate Assessments of Alternate Academic Achievement Standards Participation Rate Letters.” The letters spell out what each state must do going forward.

On March 28, 2019 the U.S. Dept. of Ed sent a memo to states providing information on the consequences they might face if they are exceeding the 1 percent cap on alternate assessments as prescribed by ESSA law and Federal regulations. Very interesting that the U.S. Dept. of Education (ED) has recently sent out a "reminder" to states about amendments to ESSA consolidated state plans and accessibility of plans since ED has been posting inaccessible state plans for more than 2 years!

We complained to ED about this back in August 2017 and their only response was to slap an "accessibility disclaimer" on the pages where the inaccessible state plan PDFs were posted!

Now ED says it "will work with you to ensure that your currently approved State plan that is posted on www.ed.gov is accessible."
