Afghanistan Legal Education Project

Afghanistan Legal Education Project Dedicated to developing innovative legal curricula to help Afghanistan’s universities train the next generation of lawyers and leaders. Founded in 2007 as a student-driven initiative, the Afghanistan Legal Education Project (ALEP) at Stanford Law School develops innovative legal curricula to help Afghanistan’s universities train the next generation of lawyers and leaders.

Mission: The people of Afghanistan have established a democratic government through competitive elections. Afghanistan’s 2004 Constitution guarantees human rights and the free exercise of all religions, and provides women with equal protection under the law. Much work is still needed, however, to institutionalize the rule of law in Afghanistan. Afghanistan’s legal sector, which suffers from a dire shortage of qualified lawyers, requires urgent attention. The assistance of skilled practitioners will be critical as the Afghan people work to reconstitute their justice system. ALEP’s principal focus is researching, writing, and publishing high-quality, original legal textbooks. Since 2007, ALEP has published three textbooks, which are among the first to specifically address Afghanistan’s post-2004 legal system: An Introduction to Afghan Law (now in its second edition), Afghan Commercial Law, and Afghan Criminal Law. All of ALEP’s textbooks have been rigorously vetted by Afghan and international legal experts. ALEP’s latest textbook, International Law from an Afghan Perspective, will be available in the fall of 2010. ALEP’s publications are available online for free use and distribution. At its inception, ALEP formed a partnership with the American University of Afghanistan (AUAF) to design an innovative legal studies curriculum for the students of Afghanistan. ALEP’s curriculum not only teaches students about the law, but also requires students to think analytically. More than sixty students have completed courses designed by ALEP in conjunction with AUAF, and an additional sixty-six students currently are enrolled in the three legal studies courses offered in the spring of 2010. These are among the most popular courses offered at AUAF. Beginning in 2011, AUAF students who complete the full legal studies curriculum will receive a Certificate in Legal Studies. Further, as Dari and Pashto translations of ALEP’s textbooks become available, ALEP is developing a strategy to encourage their use in Afghanistan’s other leading universities. ALEP builds support through site visits to Afghanistan, conferences, and fundraising initiatives. We host visiting professionals and hold symposia to improve the quality of the textbooks we produce and to ensure that our materials reach a wide audience. ALEP has obtained generous support from public and private sources, including a three-year grant from the U.S. Department of State. Constitution, Art. 19: "The flag of Afghanistan shall be made up of three equal parts, with black, red and green colors juxtaposed from left to right vertically. The width of every color shall be half of its length, and at the center of which the national insignia shall be located. The national insignia of Afghanistan shall be comprised of an emblem and a pulpit in white color—at the two corners of which are two flags, inscribed in the top middle the holy phrase “There is no God but Allah and Mohammad is his Prophet, and Allah is Great.” This shall be inscribed and superseded on rays of a rising sun, and in its lower part, the year 1919 in the solar calendar, and the word “Afghanistan” encircled on two sides by sheaves of wheat shall be inscribed. The law shall regulate the use of the flag and insignia."

Meet Freshta, an inspiring young Afghan woman from the Bayman province. Despite extremely difficult circumstances, like many others in this region, she is determined to pursue education and help others along the way. Happy Women's Day!

In celebration of International Women's Day, we share this powerful video of Freshta Ahmadi, ROYA's very first female student. She lives in a cave on the cliffs of Jograkhel in Bamyan where she is host of Bamyan's mini library. With support from Akademos Scholarship, she runs a daily classroom in her home for 25 needy children. Freshta is an emerging leader in Afghanistan who is already changing lives. Her constant struggles and sacrifices are many, her vision is clear, and with our modest support, Freshta and all ROYA students can join hands with other Afghan youth to improve their country. Happy International Women's Day to all!!

Hear from ALEP faculty, professor Erik Jensen, and ALEP student, Sean Rosenberg, about their experience of working on rule of law in Afghanistan.

In this episode of Stanford Legal, we look at the challenges of building a new democratic system of government after a nation has experience extreme upheaval--such as war and the overthrow of dictatorship. Often, citizens of these countries have limited experience with law and policy- with many public and educational institutions in disarray. The focus of Stanford's Rule of Law Program is from the bottom up -- with legal education as the first building block providing knowledge of law to a new generation of leaders so that they can be prepared to take on the challenges of rebuilding their countries.

On this show, Erik Jensen, director of Stanford’s Rule of Law program, is joined by Sean Rosenberg, JD/MBA student and West Point grad who served in Afghanistan, who works with Jensen in the Afghanistan Legal Ed Project.
