News 12 spoke with Haub Law Professor Bennett Gershman, who questions whether our democracy can survive this election.

"It's theoretically possible that corrupt electors in the particular states say we're upholding democracy, and the way we see democracy is Democrats cheated, the Republicans won, mail-in votes are fraudulent and so if these electors want to say that — what's to stop them?" asks Gershman.

Was AG right that he couldn't reveal to public his Breonna Taylor recommendation to grand jury?

Prof. Bennett Gershman, a nationally recognized expert on prosecutorial ethics who teaches law at Pace University, told the Louisville Courier Journal that under the current rules, prosecutors could elect to reveal their grand jury recommendations or keep them confidential.

Gershman said he is not aware of any prosecutor being sanctioned for disclosing a recommendation.

Experts say President Trump looks to name Ginsburg's Supreme Court successor with "unprecedented" speed

Professor Bennett Gershman, of Pace University, says, "The country is already polarized and divided, and now with this nomination to the Supreme Court, its gonna get worse."

President Donald Trump now has the chance to try to appoint a third member of his choosing, to the high court.
"Republicans in the Senate run the show and they have the power to nominate and confirm somebody to the Supreme Court, and there's nothing that Democrats can do about it," Gershman says.

The president meanwhile promises to move "without delay" on naming Ginsburg's successor, despite senate Democrats' wanting to wait, to delay a confirmation until after the election.

Gershman says, "We're gonna have to wait and see how this thing plays out, but it's gonna be ugly."

Though progressive prosecutors differ in some areas of emphasis, David Dorfman, a professor of law at Pace University, said they all embrace community engagement and restorative justice, which focuses on repairing the harm done by a crime rather than punishing the offender.
“Gonzalez has obviously very self-consciously associated himself with a national trend towards what they call ‘progressive prosecutors,’” Dorfman said. “Whereas I think DA Gonzalez is innovative and different in some ways, most of the things that he has been proposing and pushing – especially in the Justice 2020 action plan – very much follow patterns you’re seeing elsewhere.”
