Who must pay for environmental liabilities of bankrupt oil and gas companies? Can a trustee in bankruptcy walk away from a company's unproductive assets (and provincial environmental liabilities) to give priority to and satisfy secured creditors' claims (under federal bankruptcy law)? Constitutional conflict or regulatory harmony: an assessment of Orphan Well Association v Grant Thornton Ltd, 2019 SCC 5.

“Supreme Court rules energy companies must clean up old wells — even in bankruptcy”

Canada's Supreme Court rules provincial environmental rules trump bankruptcy laws in the energy sector, overturning lower court decisions that said creditors should get paid back first — before cleaning up old wells.
