Overview 😃⁣
After the 2007-08 financial crisis (aka ‘The Recession’!) the financial markets has become increasingly regulated. As a result, lawyers specialising in financial markets are now in demand as the financial sector gets to grips with its transformed world.⁣

Why is it important? What does it involve? 😃⁣
Financial markets law is vast and covers asset finance, banking, capital markets, commodity and energy trading, financial services and market regulation, funds finance, Islamic finance, private funds, restructuring and insolvency, and retail structured products.⁣

A top financial markets lawyer will look for new approaches to traditional products and will essentially act as a business adviser to their clients, so an ability to analyse and predict future market trends is an absolute must.⁣
A financial markets lawyer must have an abundance of communication skills and an ability to convey complicated information in a straightforward manner.⁣

Break it down for me a little bit! 😃⁣
Asset management involves liaising and advising with clients who have shares in a company, property investments, bonds and foreign exchange products. A lot of money is involved in asset management, so lawyers need to make sure their clients toe the line whilst making as much money as possible.⁣

Other areas will see a lawyer act for financial institutions and corporates, advising them on the regulation changes and understanding the clients’ position, having previous transactional experience and the ability to understand new regulation is a huge advantage. Commercial awareness, therefore, needs to be top-notch!⁣

Speaking of regulation, financial services and market regulation would involve work for brokerage houses, investment exchanges, investment banks, commodity traders and other financial institutions. A financial markets lawyer would advise clients on the Financial Services and Markets Act 2000, strategic regulatory issues, investigations, disputes and disciplinary matters, derivatives and commodity trading and documentation.⁣

Overview 😁⁣
White collar crime doesn’t just boil down to a murder mystery involving a suit. Rather, white collar crime is non-violent and refers to financial crimes such as fraud, bribery, embezzlement and money laundering, that are committed by businesses and governments.⁣

What Does It Involve? 😁⁣
Lawyers who specialise in white-collar crime will see themselves defending clients through an investigation, including civil and criminal litigation. Clients typically range from large corporations and banks, to individuals prominent in business and politics.⁣

Lawyers will need to be in-the-know about regulations affecting these types of organisations, as well as having a vast and in-depth knowledge surrounding the business operations of their clients. Only then can they come up with strategies and resolutions.⁣

Lawyers in this area can offer their clients top-notch legal advice on how to comply with complex governmental legislation and with investigations carried out by enforcement agencies. Lawyers will assist the client in resolving critical concerns, which can include disclosing potentially jeopardising findings or waiving privileges. Obviously, the main aim is always to resolve issues before charges are brought and to avoid future liability.⁣

Break It Down For Me A Little Bit 😁⁣
White collar crime is the term associated with a range of different crimes.⁣

Fraud boils down to deceiving someone for monetary gain. A common type of white-collar fraud is securities fraud, which comes in all shapes and sizes. However, ‘insider trading’ is where someone with a nugget of confidential inside knowledge about a company (such as upcoming earnings) trades on that information. Therefore, if an earnings report is set to hurt the company and an executive sells their stocks before this is made public, this would be securities fraud. Another type of white-collar fraud is where someone or a company gains money based on knowingly false information, such as prospects or finances.⁣

What does it involve? 😃⁣
Islamic banking has grown significantly in recent years, particularly since the banking crisis in 2008, and consequently, the area of Islamic Finance Law has too. It is the role of lawyers who operate within this area to ensure that the financial transactions of their clients comply with Shari’a - often termed ‘Shari’a Law’.  Shari’a is the body of law derived from the Quran and from secondary religious sources known as the ‘Hadith’. What is unique about Shari’a jurisprudence is that it is not confined to a specific country or state. As it is a body of law drawn from religion, it resides within the individual as religious faith does; a Muslim is expected to abide by Shari’a wherever he or she lives in the world. So, with 1.6 billion Muslims trading and travelling around the world, that’s a lot of potential clients!⁣

What does it involve? 😃⁣
Lawyers must look at transactions from all angles, identify a potential conflict of other laws with Shari’a, and write or rewrite contracts so that they are compliant. They must use their expertise in typical financial transactions and combine it with in-depth knowledge of Islamic financial practice.⁣

What are the skills I need? 😃⁣
The types of law that an Islamic Finance Lawyer uses within their practice are Capital Markets, Commercial, Contract and Civil. You need to have a broad knowledge of commercial law and then specialise in Islamic finance. In terms of qualities, it is especially important to have the ability to think innovatively and laterally. Many of the challenges faced will be new ones. It is also important to be a self-teacher and to have an open mind because moral judgements upon practices that do not align with your own must remain at the side.⁣
