So it’s getting much closer ! Very excited for the Frankfurt Investment Arbitration Moot Court (FIAMC) competition next week!

2 days ago we held a Pre-Moot against our competitors from LLOYD LAW College LLOYD LAW COLLEGE , from India. It was enriching, instructive and challenging.

Thanks to Clara Leban Vázquez and Nicolás Szlajen the coaches of the LLOYD LAW College team.

We were honored that Adv. Nir Keidar, a partner in the Gornitzky & Co. firm, a specialist in International Arbitrations, served as an arbitrator at the Pre-Moot.

As we head forward, for another Pre-Moot that we'll hold today against the team from Taras Shevchenko National University of Kyiv.

The Bar-Ilan University Frankfurt Investment Moot Court (FIAMC) team is honored to virtually host Mr. Arne Fuchs as our first international Pre-moot arbitrator for today's hearing.
During rhe hearing we will practice our oral arguments on several issues based on the 2022 case-study versus the Taras Shevchenko National University of Kyiv's team!

Frankfurt Investment
Arbitration Moot Court 2022, we are on!

השבוע נפגשה לראשונה הנבחרת של הפקולטה למשפטים באוניברסיטת בר אילן לתחרות הבינלאומית בתחום המשפט המסחרי, בוררות בדיני ההגנה על השקעות בינלאומיות. בתחרות ישתתפו מספר רב של אוניברסיטאות מרחבי העולם. המפגש נערך במשרדי גורניצקי ושות׳, יחד עם השותף ניר קידר.

במהלך המפגש, הנבחרת זכתה לפגוש את סגן הרקטור של האוניברסיטה, פרופ׳ אריה רייך ואת השותף הנכבד עו"ד חיים פרידלנד אשר נתנו הצצה לעולם הסחר הבינלאומי!

לאחר מכן, התחלנו את ההכנה לקראת התחרות. את ההנחיה ביצע מאמן הנבחרת, עו"ד ניר דויטש.

הנבחרת כוללת את הסטודנטים רהף שאהין, אריאלה מאי, הילל בילואר ושקד יגאל, ואת נחשון רובלין שתומך ומאמן את הנבחרת!

תודה רבה למשרד גורניצקי ושות׳ ולשותף ניר קידר על הקבלה והאירוח המדהים!

Another team Session, and this time – a special one!

This past week the team attended a preparation Workshop, generously hosted by & Co. Law Firm.

Under the leadership of Arne Fuchs, LL.M. (GWU) Global co-Chair of International Arbitration Group at McDermott Will & Emery and Nir Keidar, a partner in Gornitzky & Co - the team was provided with relevant and crucial information, as well as meaningful insights and observances regarding the preparation process for the moot.

We meet again! and this time – Standards of Investment Protection.

In this session, with the guidance of our coach Nir Deutsch, we explored the field of substantive protection standards, commonly contained in Bilteral Investment Treaties (BIT).

These include: 'Fair and Equitable Treatment' (FET), 'Most Favoured Nation' (MFN) and 'National Treatment' (NT).

We focused on the origins of FET standard and its relation to minimum standard of international customary law, its current use in BIT's and in international agreements and state practice.
We also discussed some important arbitration cases regarding this matter.

Another Team session, and this time - Expropriations!

In this session, the team dived into the field of Protections against Expropriations in Customary International Law and in International Investment Treaties.

The team learned about Indirect / Regulatory "taking", the differences between Lawful and Unlawful expropriations, and discussed some substantial doctrines and important arbitration cases regarding this matter.

We would like to thank Prof. Arie Reich from Bar Illan University for an interesting and enriching Lecture!
