Lok Sabha Passes National Eligibility-Cum-Entrance Test Bill:

Despite AIADMK’s walkout, the Lok Sabha on Tuesday passed the bill mandating the National Eligibility-cum-Entrance Test (NEET), a single common entrance examination for medical and dental courses. Private colleges will also be under the ambit of NEET. The NEET which will be introduced from the next academic session in 2017, is a constitutional status provided by the Indian Medical Council (Amendment) Bill, 2016, and The Dentists (Amendment) Bill, 2016. The Supreme Court had earlier ordered to implement NEET, this year. But the Bill however, deferred from the order, implementing it from the next session. Health Minister J P Nadda, who moved the bill for consideration and passing, said the new legislation has three main objectives: end the multiplicity of examinations, make them fair and transparent and ensure students are not exploited, particularly with regard to capitation fees. According to Mr Nadda, the examination will be based on NCERT syllabus. CBSE will conduct the undergraduate exam and the post-graduate exam will be conducted by national board of examination. He further said that special care will be taken to do away with the differences in syllabus and a standardised syllabus would be set so that candidates from rural belts do not face any trouble. A committee of judges will decide on the fees to be charged by the private medical colleges, while the government will fix the charges of the government institutes. Also, the test will be conducted in regional languages. AIADMK of Tamil Nadu had sought that states should not be compelled to adopt NEET, they should be able to decide whether they want their own examination or not. Mr Nadda tried to allay their fears assuring them that state’s quota would not be touched. However, the AIADMK chose to walkout.

Final decision by the Supreme Court...

The Supreme Court of India has finally put to rest all speculations surrounding National Eligibility cm Entrance Test this for this academic year.

As per the order passed today, candidates who had appeared for phase 1 of the exam will be allowed to appear for phase 2. However, this would be subject to them giving up candidature of phase 1. This would mean that if a candidate, who sat for phase 1, sits for phase 2, his score/rank secured in phase 2 exam alone will be considered for his admission.

“Only other contention relates to perceived hardship to the students who have either applied for NEET-I but could not appear or who appeared but could not prepare fully thinking that the preparation was to be only for 15% All India seats and there will be further opportunity to appear in other examinations. To allay any such apprehension, we direct that all such eligible candidates who could not appear in NEET-I and those who had appeared but have apprehension that they had not prepared well, be permitted to appear in NEET-II, subject to seeking an option from the said candidates to give up their candidature for NEET-I. It would be open to the respondents to reschedule the date of holding NEET-II, if necessary. To this extent the earlier orders stand modified.”

The Court has given CBSE and MCI the freedom to change the date for holding phase 2. Interestingly, it has appointed former Chief Justice RM Lodha to oversee the whole process. This is the fourth such committee of which Justice Lodha has been made a part.

Further, Common Entrance Tests conducted by different States will not be allowed. The Court ruled that NEET, being the creation of a Central legislation overrides States entrance exams.

The Supreme Court has adjourned the matter on the entrance test for admission to MBBS and BDS courses till Thursday as the Health Ministry and the Medical Council of India (MCI) have been asked to respond to the state governments’ plea to hold separate exams this year.

Today Supreme Court will hear petitions filed by states( like Andhra Pradesh, Maharashtra, Tamil Nadu, Karnataka) and some private medical colleges seeking permission to conduct their own entrance examinations for admissions in MBBS and BDS courses.

The Supreme Court yesterday agreed to hear a fresh plea of few states ( like Andhra Pradesh, Maharashtra, Tamil Nadu, Karnataka) and some private medical colleges association, that they be allowed to conduct their pre-scheduled entrance exam for admissions in MBBS and BDS courses.

“Let these applications be heard tomorrow by the bench concerned,” a three-judge bench headed by Chief Justice T S Thakur said when a group of senior lawyers including K K Venugopal and Gopal Subramaniam mentioned fresh applications for hearing.

Subramaniam, appearing for Jammu and Kashmir said that the entrance test being held by the state administration be allowed to go on as per schedule on the ground that it has been granted a special status.

Venugopal, who represented some private medical colleges of Karnataka, made similar pleas that the pre-scheduled entrance test may be permitted to go on alongside the NEET.

Similar requests were made by the counsel representing Andhra Pradesh, Tamil Nadu and Maharashtra. All these fresh pleas would be heard today.
