A Free Legal Aid and Awareness Program was conducted at Government Girls Senior Secondary School, Mangan, Sikkim.

The Indian Institute of Legal Studies, Siliguri, has been conducting free legal awareness programs in various Schools, Gram Panchayats, NGO's, and other institutions located in North Bengal, with the students and teachers participating in the program. The Moot Court Society of the Indian Institute of Legal Studies successfully conducted the Final Round of the Intra Moot Court Competition (January–June Session 2026), providing students with an invaluable platform to demonstrate their legal research, advocacy, analytical reasoning, and courtroom skills.

The event was presided over by our Hon'ble Founder & Chairman, Dr. Joyjit Choudhury, and Dr. Trishna Gurung, Principal-in-Charge, whose presence and guidance enriched the proceedings.

We were also delighted to welcome the students and faculty members of Sri Sri Academy, who joined us to witness the competition and engage with the practical dimensions of legal advocacy.

Topic: A Socio-Legal Study on the Functioning and Effectiveness of Registered Trade Unions in the Transport Sectors of Siliguri under the Trade Unions Act, 1926

This socio-legal research study examines the functioning, role, and effectiveness of registered trade unions operating in the transport sector of Siliguri under the provisions of the Trade Unions Act, 1926. Siliguri, being an important commercial and transportation hub connecting North Bengal and the Northeastern states, has a large number of transport workers engaged in bus services, truck and goods carriage, auto-rickshaw operations, and e-rickshaw services.

The study focuses on understanding how trade unions protect the rights and welfare of workers and how effectively labour laws are implemented in practice.

For the purpose of field research, the students conducted surveys and interviews in major transport areas of Siliguri, namely Junction, Darjeeling More, and Shivmandir. During the survey, both registered and unregistered trade unions were studied to make a comparative analysis regarding their structure, membership, legal recognition, dispute resolution mechanisms, and role in safeguarding workers interests.

The study revealed that registered trade unions generally possess better organizational structure, legal recognition, and bargaining power before authorities and employers. They are more capable of representing workers in matters relating to wages, working conditions, social security, and welfare benefits. In contrast, unregistered unions, though active at the grassroots level, often lack legal protection, formal recognition, and financial stability, which limits their effectiveness in collective bargaining and labour dispute.

Overall, the project adopts a socio-legal approach by combining legal analysis with empirical field data collected from transport workers and union representatives in Siliguri. The study aims to provide a better understanding of the real condition of trade unions in the transport sector and suggests the need for stronger implementation of labour laws, greater awareness among workers, and improved coordination between trade unions and government authorities.

Alongside the awareness session, a door-to-door legal survey was conducted among the residents of Chamurchi Tea Garden to understand the legal and social challenges faced by the local community. The interaction enabled the team to identify issues requiring legal intervention while creating an opportunity to directly engage with and assist the residents.

The session was highly interactive, informative, and impactful, with enthusiastic participation from the local community. It proved to be one of the most meaningful outreach initiatives, helping spread legal awareness, strengthen access to justice, and empower individuals with knowledge of their legal rights and remedies.

A special empirical research titled “A study on the health and the safety of the workers in the factories in Siliguri” was conducted by the students of VI Semester (B.com) under the supervision of Ms. Sahansheela Sharma. The study on the health and safety of workers in factories in Siliguri examines the working conditions, occupational hazards, and legal protections available to industrial workers employed in factories and manufacturing units.

Siliguri, being an important commercial and industrial hub of North Bengal, has several small and medium-scale factories such as tea-processing units, food-processing industries, plastic factories, packaging units, and workshops. Workers in these industries often face risks related to unsafe working environments, lack of protective equipment, long working hours, and inadequate health facilities.

The research was conducted by first visiting the labour Commissioners and then later by surveying the workers of factories in Siliguri. The study highlights that many factory workers are exposed to occupational hazards such as dust, smoke, excessive noise, chemical exposure, machine-related injuries, poor ventilation, and unhygienic conditions.

These hazards may lead to respiratory diseases, skin infections, hearing problems, fatigue, stress, and accidental injuries. In some factories, workers are not adequately trained in safety measures, which increases the possibility of workplace accidents. The research also focuses on the implementation of the Factories Act, 1948 and the Occupational Safety, Health and Working Conditions Code, 2020 in protecting workers’ rights. The Factories Act provides provisions regarding cleanliness, ventilation, drinking water, lighting, sanitation, safety equipment, working hours, medical facilities, and welfare measures for workers.

The study finds that although these legal provisions exist, their implementation in many factories remains weak because of poor inspection systems, lack of awareness among workers, and negligence by employers.
Another important aspect of the study is the socio-economic condition of factory workers. Most workers belong to economically weaker sections and continue working despite unsafe conditions due to fear of unemployment and low income.

Temporary and contract workers are more vulnerable because they often lack job security, insurance, and medical benefits. The study concludes that there is a strong need for effective enforcement of labour laws, regular factory inspections, health awareness programmes, proper safety training, and provision of protective equipment to workers. Employers, government authorities, and labour organisations must work together to ensure safe and healthy working conditions in factories in Siliguri. Improving workplace safety will not only protect workers’ health but also increase productivity and industrial development in the region.
