តេីអ្វីទៅជា​យន្តការ​ផ្សះផ្សា​រ​ដោយ​ចាប់បង្ខំ?

ជូនបងប្អូនជនរួមជាតិជាទីស្រលាញ់។

ថ្ងៃនេះរាជរដ្ឋាភិបាលកម្ពុជាបានសម្រេច នឹងប្រើប្រាស់យន្តការនៃការផ្សះផ្សារដោយចាប់បង្ខំ រឺមួយក៏យើងអាចហៅថា (Compulsory Conciliation) ដែលស្ថិតនៅក្រោមអនុសញ្ញាអង្គការសហប្រជាជាតិ ស្តីពីនីតិសមុទ្រ (UNCLOS) ដើម្បីស្វែងរកដំណោះស្រាយដោយសន្តិវិធី ផ្អែកលើមូលដ្ឋានច្បាប់ ក្នុងការដោះស្រាយតំបន់ទាមទារដែនសមុទ្រត្រួតគ្នារវាងកម្ពុជានិងថៃ បន្ទាប់ពីភាគីថៃបានប្រកាសជាផ្លូវការ សម្រេចដកខ្លួនដោយឯកតោភាគីចេញពីអនុស្សរណៈនៃការយោគយល់គ្នារវាងកម្ពុជា-ថៃ រឺហៅកាត់ថា MOU 2001 (ឬដែលភាគីថៃហៅថា MOU44) ។

ជាង25ឆ្នាំកន្លងមកនេះ អនុស្សរណៈនៃការយោគយល់គ្នារវាងកម្ពុជា-ថៃ MOU2001 បានដើរតួនាទីយ៉ាងសំខាន់ ដែលជាក្របខណ្ឌទ្វេរភាគីតែមួយគត់ដែលបានឯកភាពគ្នា សម្រាប់ភាគីទាំងពីរក្នុងការដោះស្រាយតំបន់ទាមទារដែនសមុទ្រត្រួតគ្នា ហើយការចូលជាធរមាននៃអនុស្សរណៈនៃការយោគយល់គ្នានេះ បញ្ជាក់អោយឃើញអំពីស្មារតីនៃកិច្ចសហប្រតិបត្តិការ និងសុច្ឆន្ទៈទៅវិញទៅមក។

ជាការសោកស្តាយ ដែលភាគីថៃបានសម្រេចដកខ្លួនជាឯកតោភាគីចេញពីអនុស្សរណៈនៃការយោគយល់គ្នាមួយនេះ ហើយសម្រាប់កម្ពុជាយើងតែងតែផ្តល់លទ្ធភាពទៅដល់យន្តការទ្វេភាគី ដែលស្របទៅនឹងតាមអនុស្សរណៈនៃការយោគយល់គ្នាមួយនេះ។ ការដកខ្លួន ដោយឯកតោភាគីចេញពីអនុស្សរណៈនៃការយោគយល់គ្នានេះ គឺជាការបោះបង់ចោលកិច្ចព្រមព្រៀងទ្វេរភាគីតែមួយគត់ ដែលបង្កើតអោយមានក្របខណ្ឌទ្វេរភាគីតែមួយគត់ ដែលភាគីទាំងពីរបានពឹងផ្អែក និងប្រើប្រាស់ជាង ២ទស្សវត្សន៍កន្លងមកនេះ។

ក្នុងករណីនេះ ក្នុងនាមជារដ្ឋដែលគោរព និងប្រកាន់ខ្ជាប់ច្បាប់អន្តរជាតិ ក៏ដូចជាការដោះស្រាយជម្លោះដោយសន្តិវិធី កម្ពុជាពុំមានជម្រើសអ្វីក្រៅពីពឹងផ្អែកទៅលើច្បាប់អន្តរជាតិ និងអនុសញ្ញាអង្គការសហប្រជាជាតិ ស្តីពីនីតិសមុទ្រ ជាពិសេសយន្តការនៃការផ្សះផ្សារដោយចាប់បង្ខំ (Compulsory Conciliation) ដែលបង្កើតឡើងក្រោមអនុសញ្ញាមួយនេះនោះទេ។

ឆ្លៀតក្នុងឱកាសនេះ ខ្ញុំក៏ចង់បញ្ជាក់បន្តិចដែរថា យន្តការនៃការផ្សះផ្សារដោយចាប់បង្ខំ (Compulsory Conciliation) គឺត្រូវបានបង្កើតឡើងដោយអនុសញ្ញាអង្គការសហប្រជាជាតិស្តីពីនីតិសមុទ្រ (UNCLOS) ដើម្បីជួយទៅដល់រដ្ឋភាគី ដើម្បីដោះស្រាយជម្លោះដោយសន្តិវិធី និងស្របទៅតាមច្បាប់អន្តរជាតិ។ ការសម្រេចចិត្តរបស់កម្ពុជា គឺឆ្លុះបញ្ចាំងអោយឃើញអំពីសេចក្តីសង្ឃឹមដ៏ស្មោះត្រង់របស់យើង ដែលប្រទេសយើងទាំងពីរអាចសម្រេចបាននូវដំណោះស្រាយមួយ ដោយយុត្តិធម៌ដែលយូរអង្វែង ហើយស្របទៅតាមច្បាប់អន្តរជាតិ ដែលនឹងអនុញ្ញាតអោយប្រជាជនយើងរស់នៅជាមួយគ្នាដោយសន្តិភាព ស្ថេរភាព និងសេចក្តីសុខ។


Dear Compatriots,

Today, the Royal Government of Cambodia has decided to pursue the mechanism of Compulsory Conciliation under United Nations Convention on the Law of the Sea (UNCLOS) in order to find a peaceful resolution based on international law for maritime overlapping claim area between Cambodia and Thailand, after Thailand has officially declared the unilateral withdrawal from the Memorandum of Understanding between Cambodia and Thailand, also known as the MOU 2001 (Thai reference as MOU44).

For more than 25 years, this Memorandum of Understanding has played a crucial role as a mutually agreed bilateral framework for both sides to address overlapping maritime claims. The entry into force of this Memorandum of Understanding reflects the spirit of cooperation and mutual goodwill.

It is regretful that Thailand has decided to unilaterally withdraw from this Memorandum of Understanding. For Cambodia, we have always given priority to bilateral mechanisms in line with this Memorandum of Understanding for dealing with our overlapping maritime area. This unilateral withdrawal from this Memorandum of Understanding would reject the only bilateral agreement, which constitutes the only bilateral framework that both parties have relied upon for more than two decades.

In this case, as a state that firmly respects and adheres to international law and the peaceful settlement of disputes, Cambodia would be left with no choice but to rely upon international law and the United Nations Convention on the Law of the Sea (UNCLOS), particularly the mechanism of Compulsory Conciliation under this Convention.

Taking this opportunity, I would like to clarify that this mechanism of Compulsory Conciliation is established by the UNCLOS to assist state parties in resolving disputes peacefully in accordance with international law. Therefore, Cambodia’s decision reflects our sincere hope that both countries can reach a just and lasting solution in line with international law, allowing our peoples to live together in peace, stability, and harmony.

Student Spotlight: Negotiation in Action (Role-Play)
In this video, our International Relations students demonstrate their classroom learning through a realistic role-play. This exercise is a practical application of the negotiation theories and conflict management styles we study in school.

Watch how "Jenna" and "Danita" navigate a rent dispute using professional negotiation tactics:

The Nature of Negotiation
• Interdependence: The tenants need a home, and the landlord needs reliable income; they are "stuck" together and must find a mutual solution.
• Compromising Style: The parties move from conflict to a middle ground, where both sides give up something to reach a fair deal.

Communication & Influence
• Active Listening & Feedback: Instead of just arguing, the characters listen to each other's reasons—balancing maintenance costs against student budgets.
• Central Route Influence: Jenna uses logic and facts about their status as students to change the landlord's mind.(Pheara)
• Reciprocity: The students use an "Exchange" rule—offering a one-year contract and better house care in return for a smaller rent increase.

Finding and Using Power
• Relationship-Based Power: Because they have a "strong tie" as good, long-term tenants, the landlord values them more than strangers.
• Contextual Power (BATNA): By offering a guaranteed contract, the girls create a better "alternative" for the landlord than the risk of searching for new tenants.
• Third-Party Influence: We see how Sreynou (the mother) uses her influence to help both sides move from "Positions" to "Interests".

The Result: A Win-Win Agreement
By focusing on Relationship-Based Ethics and honesty, the students reach a result that is fair and sustainable. This role-play shows that negotiation is not about "winning" over others, but about finding a way forward together. Coordination by Dr. MEN Sokheang.

On 4 April 2026, two groups of students at PPIU's Faculty of Law and Economics shared two crucial topics: Rights to Expression in Cambodia — its importance, the challenges, and efforts to promote — and Women’s Rights in Cambodia — improvements, challenges, and promotion.

The sessions are aimed at boosting students' academic research and sharing their findings among classmates. The discussions highlighted how freedom of expression underpins democracy, accountability, and social progress, while noting some challenges. It also covered gains for women in education and health alongside ongoing issues such as gender-based violence, economic marginalization, and underrepresentation in leadership.

The event fostered lively debate, collaboration, and a team commitment to producing research as a part of their term requirement.
