Subject: PTT group must stop funding crimes against humanity in Myanmar
PTT is the largest buyer of gas from Myanmar and its subsidiary, PTTEP, is the operator of two of Myanmar’s gas fields. Each month, PTT group transfers millions of dollars that are due to the Myanmar government instead to bank accounts controlled by a brutal criminal junta that is committing war crimes and crimes against humanity, including sexual violence, torture, deliberate campaign against of civilians, and murder. ASEAN has refused to recognise the junta and has once again banned it from the ASEAN summit. PTT group continues to choose to treat it like a government.
You claim that your human rights policies are based on the United Nations Guiding Principles on Business and Human Rights (UNGP). Yet the UNGP clearly state that “questions of complicity may arise when a business enterprise contributes to or is seen as contributing to, adverse human rights impacts caused by other parties.” PTT Group is the largest single source of revenue to the junta – its contribution is substantial as the junta relies on it to pay for jet fuel and weapons to target civilians. Your failure to divert revenues is a breach of the UNGP.
The UN Human Rights Office has called on the international community to cut off revenues to the junta, noting that gas revenues are the largest source of foreign revenue and are due to the Myanmar Oil and Gas Enterprise (MOGE) which is a government department. It called on businesses to ensure they do not “remain in a business relationship of any kind with the Tatmadaw, or any enterprise owned or controlled by them.”
The shareholders of one of your partners in crime, TotalEnergies, demanded that Total exit because it was “directly financing the current military dictatorship’s ongoing acts of crimes against humanity.” The shareholders of another of your partners in crime, Chevron, demanded that Chevron divert funds due to the government in Myanmar into protected accounts. Total even blamed PTT, effectively stating that if Total tried to divert funds, you’d find ways to ensure the junta could access the revenues.
PTT should have reached the same conclusions from its own Human Rights Due Diligence. Meanwhile, your website claims you’ve had no complaints to your human rights whistle-blower facility, which apparently does not count demands from our National Unity Government to stop colluding with a terrorist junta. You also claim to adhere to principles of good corporate governance while transferring millions to bank accounts controlled by a junta that is pushing Myanmar towards joining Iran and North Korea on a money laundering blacklist.
You have justified your complicity by stating that you are “putting the utmost importance for energy security of both Thailand and Myanmar.”
- No-one asked you to turn the gas off, just to stop breaching your contracts with our government by channelling the funds to the junta.
- For decades you have ripped gas out of Myanmar at knock down prices while the military and its cronies line their pockets with the revenues and two thirds of our country remained without electricity – you have consistently undermined our energy security.
- In Thailand, you have invested in LNG infrastructure – you know that you could, replace Myanmar gas with LNG but that it would hit your profits.
Please consider this letter to be a complaint:
- PTT group is financing atrocity crimes in Myanmar and making misleading claims to justify its complicity.
- PTT group should pay funds due to the Myanmar government to the NUG or into protected accounts that the junta cannot access.
