A Workshop to Remember

On July 2nd, 2025, The Tax Club, Bayero University Kano held a milestone Workshop on “Air Pollution & Pollution Taxation in Nigeria” — a timely conversation at the intersection of taxation and environmental sustainability.

Facilitated by the insightful Dr. Edidiong Bassey, a distinguished lecturer from the UK, this workshop explored how tax policy can be a powerful tool in curbing pollution — not only in Nigeria but globally.

Participants were segmented into thematic groups focused on:

1. Industrial Pollution

2. Energy Pollution

3. Transportation pollution

4. Environmental Sustainability and more — where thought-provoking discussions, case-based interactions, and solution-oriented brainstorming took place.

From filled questionnaires to engaging Q&A sessions, the event captured diverse perspectives on how taxation could drive cleaner air, safer communities, and better policy outcomes. Where TAX meets TRASH, innovation sparks change!

Weekly Tax Nugget: Bayero University, Kano.

Withholding Tax (WHT) is an advance tax deducted at source from specific payments made to individuals or companies. The payer deducts and remits it directly to the appropriate tax authority.

Applicable Payments and Rates:
- Rent: 10%
- Dividends/Profits: 10%
- Interest: 10%
- Royalties: 5%

Eligibility to File:

You must file a WHT return if you received any income (e.g., rent, dividends, interest, royalties, contracts, commissions) from which tax was deducted during the year.

Filing Options:

1. Manual Filing – Submit physical forms at FIRS or State IRS offices.
2. Electronic Filing – Use FIRS or state e-filing portals for online submission.

Transactions Subject to WHT:

• Construction, supply, and survey contracts
• Consultancy and professional services
• Dividends, interests, and royalties
• Rent on land, buildings, or assets

Important Dates:

10 April 2025: Deadline for PAYE remittance
21 April 2025: Deadline for VAT and WHT remittance

What is Treaty Shopping?
Treaty Shopping is a tax avoidance tactic where investors route income through a third country with a favourable tax treaty - despite having no real economic activity there - to enjoy reduced tax rates.

Illustration
A US company invests in Nigeria but channels the investment through Netherlands to benefit from the Nigeria - Netherlands treaty lower withholding tax on dividends, instead of paying the high rate under the Nigeria - US treaty.

Impact on the Nation's economy

• Revenue loss for source countries
• Abuse of treaty benefits

How to mitigate it

• Limitation of benefits (LOB) clauses
• Strong domestic anti-avoidance law

Bottom line

Tax treaties are meant to encourage genuine cross - border investments - not to be exploited. Countries must stay proactive in closing abuse loopholes
