๐ช๐๐๐ฅ๐๐๐ฆ, Article XXII, Section 6 stated that โThere shall be a Commission on Elections referred to as the COMELEC. It shall supervise and conduct the electoral process of the positions for the Executive and Legislative offices.โ
๐ช๐๐๐ฅ๐๐๐ฆ, Section 11, clauses a and c of the same Article stated that โIt shall be the duty of the COMELEC to conduct election in an efficient and effective manner; and Be the sole judge of all election protests that shall include objections to the qualifications of the candidates, protests on the conduct of election campaign, casting of votes, canvassing of votes, and violation of rules and regulations.โ
๐ช๐๐๐ฅ๐๐๐ฆ, the CEMDS-SC COMELEC upholds the principles of integrity, transparency, fairness, accountability, and efficiency in the conduct of the CEMDS-SC elections;
๐ช๐๐๐ฅ๐๐๐ฆ, the Commission recognizes the necessity of amending certain provisions of the CEMDS-SC Election IRR Act of 2026 to ensure that the implementation of documentary requirements remains equitable, reasonable, and practicable for all aspiring candidates;
๐ช๐๐๐ฅ๐๐๐ฆ, the Qualifications and Requirements under the CEMDS-SC Election IRR Act of 2026 require a Certificate of Good Moral Character as one of the documentary requirements for candidates seeking to proceed with their official candidacy;
๐ช๐๐๐ฅ๐๐๐ฆ, the prescribed filing period for the Certificate of Candidacy is scheduled on August 25โ27, 2026, as provided in the Election Period Timeframe of the CEMDS-SC Election IRR Act of 2026;
๐ช๐๐๐ฅ๐๐๐ฆ, the Commission recognizes that the limited timeframe for the filing of candidacy may not provide sufficient opportunity for aspiring candidates to secure their Certificate of Good Moral Character, considering that the issuance of such document is subject to the processing procedures and turnaround time of the registrar office;
๐ช๐๐๐ฅ๐๐๐ฆ, requiring the immediate submission of the Certificate of Good Moral Character within the filing period may unintentionally disadvantage otherwise qualified candidates who have complied with the requirement but are unable to obtain the document within the prescribed period due to processing constraints beyond their control;
๐ช๐๐๐ฅ๐๐๐ฆ, the Commission deems it necessary to provide a reasonable extension for the submission of the Certificate of Good Moral Character while maintaining the document as a mandatory requirement for the validation and confirmation of a candidate's qualifications;
๐ช๐๐๐ฅ๐๐๐ฆ, such extension is intended solely to accommodate the administrative processing period required for the issuance of the document and shall not be construed as a waiver, removal, or exemption from the documentary requirement;
๐ช๐๐๐ฅ๐๐๐ฆ, the Commission, in the exercise of its mandate to conduct the election in an efficient, effective, fair, and systematic manner, finds it necessary and appropriate to amend the relevant provisions governing the submission of documentary requirements for candidates;
๐ก๐ข๐ช ๐ง๐๐๐ฅ๐๐๐ข๐ฅ๐, pursuant to the powers in the CEMDS-SC COMELEC by the 2022 Constitution and By-Laws of College of Economics, Management and Development Studies - Student Council, hereby RESOLVES, that the qualifications and requirements for aspiring CEMDS-SC officers be amended.
๐ฅ๐๐ฆ๐ข๐๐ฉ๐๐ ๐๐จ๐ฅ๐ง๐๐๐ฅ, that in the conduct of the 2026-2027 CEMDS-SC Elections, the promotion of gender equality and sensitivity, and the observance of fair, honest, democratic, and systematic elections shall be mandatory and strictly observed
๐ฅ๐๐ฆ๐ข๐๐ฉ๐๐ ๐๐๐ก๐๐๐๐ฌ that this resolution shall take effect after its publication. Let the Commission on Elections implement this Resolution.
