On December 7-8, 2024, we had another inspiring session of the ICC training series at the Faculty of Law and Administration in Kraków.

🔹 Day 5: Conservatory and Interim Measures

🔹 Day 6: Evidence
Trainers: Carole Malinvaud, Bartosz Krużewski

These two intensive days were dedicated to deep dives into interim measures and evidence in arbitration. Thanks to our exceptional speakers, participants had the opportunity to gain invaluable knowledge and practical skills that will undoubtedly enhance their professional careers.

The ICC Comprehensive Training on Arbitration Practice at JU 2024/2025 has officially reached its halfway point with the conclusion of Workshop 2.

Day 3 (Saturday) focused on Appointment of Arbitrators and Case Management, while Day 4 (Sunday) explored ADR and Settlement, culminating in a dynamic and highly productive mock negotiation and mediation session between the counsels of two companies seated in different states whose promising commercial collaboration had been disrupted by mutual allegations of the breach of contract leading to the termination of their agreement and multiple claims and counterclaims submitted to arbitration pursuant to ICC Rules.

A heartfelt thanks to our exceptional trainers — Patricia Shaughnessy, Małgorzata Surdek-Janicka, Philipp Landolt, and Olena Perepelynska — for their remarkable ability to engage and inspire Participants. Special recognition also goes to the course’s rock-solid co-director, Maciej Jamka, FCIArb, for steering the program with excellence as well as Ruslan Mirzayev and other Colleagues supporting us from Krakow (Maria Gruszczynska and Rafał Wieczerzak) and Paris / ICC Dispute Resolution Services (Shofa Fathyamala).

It was also a pleasure to have Peter Rižnik here in Krakow, who not only contributed as one of the speakers at the ICC YAAF event on Friday, but also, quite spontaneously showed up on our course on Saturday and Sunday joining us for a while and sharing his valuable views on some of the issues analyzed during these intensive and immersive training sessions.

These essential questions were at the heart of last Friday’s ICC YAAF event held at the Jagiellonian University in Krakow.

The event featured an inspiring keynote speech by Professor Patricia Shaughnessy and a dynamic panel discussion with emerging arbitration practitioners who have already gained substantial experience as arbitrators:

🌟 Workshop 1 Completed! 🌟

Last Saturday-Sunday we held our first intensive arbitration workshop, and it was a pleasure connecting with everyone who joined us.
Thank you to all who contributed — your engagement, passion, curiosity and stamina (which is truly necessary to stay awake, focused and active throughout 8 hours of classes including few short coffee breaks and a lunch break - just as during the intense arbitral hearing!) truly brought our discussions and exercises based on the mock case to life.

Anyone familiar with international commercial arbitration knows that party autonomy is its cornerstone.

But have you ever considered:
❓What are the theoretical foundations of party autonomy?
❓What values underpin this principle, and equally important, which values or principles may conflict with it?
❓What are the boundaries of party autonomy, particularly in institutional versus ad hoc arbitration?
❓What are the potential consequences of violating party autonomy, or, conversely, exceeding its limits, for the arbitral award? Is there any prevailing practice and/or pertinent case law of leading arbitral institutions and state courts of major arbitral jurisdictions on these matters?

These crucial questions were expertly addressed in the keynote speech by Małgorzata Surdek-Janicka, Vice-President of the ICC International Court of Arbitration, during the Opening Ceremony and Inauguration Lectures of the ICC Comprehensive Training on Arbitration Practice at JU 2024/2025 on September 30, 2024.
