Your biggest legal exposure might already work for you. Handling internal behavior correctly, and documenting it correctly, protects the company. Most employee problems become legal problems only when the paperwork was never in place.

Confidentiality is not automatic. Employees need to sign the correct documentation to keep company material confidential, noncompetes and nondisclosures, signed by all employees, before there is ever a reason to need them.

Legal issues do not care that you have no lawyer on staff. Most growing companies hit legal questions multiple times a month, but only have true legal matters a few times a year. Not enough for a full time hire. Too much to handle alone.

A DUI does not end at the arrest. The consequences can follow you for 18 months to 3 years, and sometimes longer. Most people only think about the court date.

Here’s what it can actually cost: alcohol awareness classes, probation and fees, an ignition interlock device on your vehicle for a year, restrictions on your license, possible jail time, attorney fees. And that list isn’t exhaustive.

What a good DUI outcome looks like. Results range from a dismissal, to a not guilty finding, to probation before judgment, to a conviction, up to jail time. The difference often comes down to preparation and history.

Sometimes you win outright. When there’s no real reason to believe you were under the influence, no admission, no field sobriety test due to a refusal or a faulty one, and no intoximeter results, that may be a case worth trying in front of a judge or jury. The roadside DUI breath test is not what counts. The test on the street is not admissible in court. The test at the precinct is the one that matters, and refusing it carries a mandatory license suspension with limited options to circumvent. Know what you are choosing before you choose it.

Every DUI stop is on camera. Nearly every stop is captured on the officer’s body camera, from the first question to the last, and that recording becomes evidence in discovery. If a health issue such as a knee or hip problem prevents you from doing a field sobriety test, say so clearly on camera so the recording preserves it.
