President Obama’s 2012 Deferred Action for Childhood Arrivals Program (DACA) authorized nearly 700,000 Dreamers the opportunity to work and remain excluded from deportation. Last month, however, the Fifth Circuit Court of Appeals set off a chain of events jeopardizing DACA. Unless Congress acts, the ruling places DACA at risk and negates the federal promises to Dreamers. A consistent thread to the past shows DACA sitting at the apex of systemic racism grounded in the legal system and remaining hidden history in legal education. This presentation addresses the historical legal context when federal law structurally thwarted equal protection under the law permitted non-persons of color and disallowed the Mexican, Spanish, Indigenous, and Black populations remaining after the 1848 war with Mexico. Holding estates of varying sizes most lost their property yielding to impoverished circumstances. An otherwise diverse economy thereafter lapsed to federal law expediting the disparate treatment of people of color that taints the present. If deported from the U.S. eliminating DACA not only irreparably harms Dreamers as those in the past but further precludes a wide-based diverse economic sector in the present with trajectories long into the future.
