On 23 October 2026, the Obligations Lab Asia of Centre for Comparative and Transnational Law, CUHK LAW hosted Prof. Mark Bennett, Associate Professor at Te Herenga Waka, Victoria University of Wellington, New Zealand, for a seminar on “Reconsidering the Sham and Illusory Trust Doctrines in light of Settlor Control and Beneficiary Disempowerment”.

Drawing on foundational and recent case law, Prof. Bennett explored how settlor control — exercised through reserved powers, formal roles within trust structures and, particularly, letters of wishes — may challenge the boundaries of legitimate trust arrangements. He also evaluated how sham and illusory trust doctrines may help address these challenges.

The Centre for Comparative and Transnational Law, CUHK LAW was delighted to host Prof. Aaron Yoong, Assistant Professor of Law at Singapore Management University, for a joint CCTL Obligations Lab Asia and Faculty Research Seminar on "Surreptitious Reform of the Duty of Care in Negligence".

Centring his presentation on the landmark Singapore decision 𝘋𝘦𝘭𝘰𝘪𝘵𝘵𝘦 & 𝘛𝘰𝘶𝘤𝘩𝘦 𝘷 𝘏𝘪𝘯 𝘓𝘦𝘰𝘯𝘨 𝘛𝘳𝘢𝘥𝘪𝘯𝘨 alongside recent English and Singaporean authorities, Prof. Yoong explored how courts have shifted questions between the duty of care and other elements of actionable negligence and considered the implications for the structure of negligence analysis.

On 22 October 2026, the Centre for Legal Innovation and Digital Society, CUHK LAW hosted its landmark 20th Intellectual Property Law Seminar, featuring 𝗗𝗿 𝗠𝗮𝘅𝗲𝗻𝗰𝗲 𝗥𝗶𝘃𝗼𝗶𝗿𝗲, Lecturer in Law at King's College London, whom we were delighted to welcome as the first visiting scholar under CUHK LAW’s Emerging Scholars Visiting Scheme in 2026–27.

In this insightful seminar, Dr Rivoire presented key findings from his forthcoming book, The Principles of Territoriality in Intellectual Property Arbitration. He explored how territoriality — often invoked as a self-evident, monolithic principle in resolving jurisdictional and choice-of-law issues — is in fact a complex umbrella term encompassing several distinct concepts.

Drawing on comparative source material and recent arbitral awards, Dr Rivoire integrated insights across intellectual property law, international arbitration, and private international law to disentangle these meanings. His presentation examined how different understandings of territoriality directly impact both the arbitrability of IP disputes and the determination of applicable law in modern cross-border arbitrations.
