🏆We are thrilled to announce that Prof. Jae Woon Lee has been awarded the Mr. and Mrs. Joseph W N Cheung Prize for Research Excellence 2025-26!

Prof. Lee received the prize for his article “Regulating Carbon Emissions from International Aviation through Air Services Agreements: Lessons from Aviation Safety Enforcement”, which addresses how air services agreements (ASAs) are starting to be used to regulate carbon emissions from international aviation.

Established in 2021, the prize aims to promote research excellence and honour outstanding early-career academic staff at CUHK LAW.

Prof. Jyh-An Lee and Dr Jingwen Liu have published a co-authored book chapter entitled “Criminal Enforcement of IP in Hong Kong” in Kung-Chung Liu and Tianxiang He (eds.) 𝘊𝘳𝘪𝘮𝘪𝘯𝘢𝘭 𝘐𝘯𝘵𝘦𝘭𝘭𝘦𝘤𝘵𝘶𝘢𝘭 𝘗𝘳𝘰𝘱𝘦𝘳𝘵𝘺 𝘌𝘯𝘧𝘰𝘳𝘤𝘦𝘮𝘦𝘯𝘵 𝘪𝘯 𝘈𝘴𝘪𝘢: 𝘚𝘰𝘶𝘳𝘤𝘦𝘴, 𝘚𝘪𝘨𝘯𝘪𝘧𝘪𝘤𝘢𝘯𝘤𝘦, 𝘢𝘯𝘥 𝘚𝘪𝘥𝘦-𝘌𝘧𝘧𝘦𝘤𝘵𝘴 (Oxford University Press, 2026).

Abstract: This chapter provides a comprehensive overview of the criminal enforcement of IP in Hong Kong. It begins by delineating the primary categories of criminal IP enforcement, with a particular emphasis on copyright and trademarks. Additionally, it explores the potential for criminal prosecution in cases of patent, design, and trade secret infringement and misappropriation, including relevant efforts towards criminalization in these areas. The chapter then delves into the distinctive institutional framework for criminal IP enforcement in Hong Kong, led by the Customs and Excise Department (C&ED), the agency responsible for the investigation and prosecution of criminal IP violations. Finally, it addresses occasional but noteworthy discussions within the private sector regarding criminal IP enforcement, highlighting the broader implications and ongoing debates surrounding this critical issue.

💡𝗖𝗖𝗧𝗟 𝗘𝗻𝘃𝗶𝗿𝗼𝗻𝗺𝗲𝗻𝘁𝗮𝗹, 𝗘𝗻𝗲𝗿𝗴𝘆 𝗮𝗻𝗱 𝗖𝗹𝗶𝗺𝗮𝘁𝗲 𝗟𝗮𝘄 𝗖𝗹𝘂𝘀𝘁𝗲𝗿 𝗦𝗲𝗺𝗶𝗻𝗮𝗿

In April 2025, the IMO approved draft amendments to MARPOL Annex VI to introduce the IMO Net-Zero Framework. If adopted, it will serve as the main policy to drive global emission reductions in international shipping. In the meantime, alternative proposals for decarbonizing the shipping sector have emerged at the IMO, and the EU and other actors have advanced work on regional and national shipping decarbonization policies. This Seminar will discuss the potential risks posed by a fragmented regulatory landscape as well as options to address these risks.

🏆We are pleased to share that Prof. Dicky Tsang has been awarded a competitive General Research Fund (GRF) grant in the amount of HK$982,490 for a 36-month project from the Research Grants Council (RGC).

Prof. Tsang’s awarded project, entitled “Harmonization of Choice of Law in China”, aims to analyse the current divergence in contractual choice of law rules across Chinese Mainland, Hong Kong, and Macau through comparative and empirical research. The project will explore effective approaches to harmonising these rules, providing a workable legislative blueprint to enhance legal predictability, reduce transaction costs, and facilitate economic integration within the region.

Prof. Yueming Yan has published a book chapter entitled “International trade law and labor rights protection” in 𝘛𝘩𝘦 𝘌𝘭𝘨𝘢𝘳 𝘊𝘰𝘮𝘱𝘢𝘯𝘪𝘰𝘯 𝘵𝘰 𝘐𝘯𝘵𝘦𝘳𝘯𝘢𝘵𝘪𝘰𝘯𝘢𝘭 𝘛𝘳𝘢𝘥𝘦 𝘓𝘢𝘸 𝘢𝘯𝘥 𝘵𝘩𝘦 𝘚𝘶𝘴𝘵𝘢𝘪𝘯𝘢𝘣𝘭𝘦 𝘋𝘦𝘷𝘦𝘭𝘰𝘱𝘮𝘦𝘯𝘵 𝘎𝘰𝘢𝘭𝘴 (Edward Elgar Publishing, 2026).

Abstract: The 2030 Agenda for Sustainable Development that establishes 17 Sustainable Development Goals (SDGs) explicitly acknowledges the connection between trade and labor rights through Goal Eight (Decent Work and Economic Growth) and Goal Five (Gender Equality). International trade presents significant opportunities for women's employment and poverty reduction, while also serving as a platform to safeguard labor rights, including gender equity in employment and the elimination of child labor. The discussion of ‘social value’ in the context of world trade law predates the inception of the World Trade Organization (WTO). A global consensus on the importance of protecting labor rights in trade processes was first widely recognized during the 1996 WTO Ministerial Conference in Singapore. Over time, as labor rights have evolved, innovative approaches and mechanisms have been developed globally to promote labor protection across various legal regimes. In particular, despite the absence of explicit references to labor rights in WTO agreements, the increasing inclusion of labor clauses in free trade agreements (FTAs) serves as compelling evidence of the growing recognition of the labor–trade nexus and states’ commitments to labor protection through trade. This chapter examines the relationship between trade and labor protection by exploring its historical context, recent developments, and potential future trajectories.

Through the 𝗖𝗨𝗛𝗞 𝗟𝗔𝗪 𝗨𝗻𝗶𝘁𝗲𝗱 𝗡𝗮𝘁𝗶𝗼𝗻𝘀 𝗜𝗻𝘁𝗲𝗿𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹 𝗟𝗮𝘄 𝗖𝗼𝗺𝗺𝗶𝘀𝘀𝗶𝗼𝗻 𝗥𝗲𝘀𝗲𝗮𝗿𝗰𝗵 𝗔𝘀𝘀𝗶𝘀𝘁𝗮𝗻𝘁 𝗣𝗿𝗼𝗴𝗿𝗮𝗺𝗺𝗲, our outstanding LLB students have the opportunity to gain first-hand experience at the forefront of international law in Geneva, Switzerland.

Supported by a Faculty bursary, LLB students Charles Chan and Yueyun Hu spent two weeks in May/June 2026 serving as Research Assistants under the supervision of Professor Martins Paparinskis, a globally respected international lawyer and member of the United Nations International Law Commission representing Latvia and the Baltic States.

This unique experience allows students to observe the work of the International Law Commission, the United Nations body responsible for the progressive development and codification of international law, while contributing to cutting-edge legal research in a truly international setting.

This Programme offers an extraordinary opportunity for aspiring lawyers to broaden their horizons, engage with global legal issues, and witness international law in action.

This Conference will build on this tradition by providing a forum for open and informed discussion on the future of legal education in Hong Kong and internationally, bringing together a diverse group of local and international educators, legal practitioners, and students.

Prof. Lutz-Christian Wolff has published an article entitled “Shanghai in the 1930s, the German Civil Code and the Tragic Story of a Brilliant Legal Mind” in the 𝘕𝘰𝘵𝘳𝘦 𝘋𝘢𝘮𝘦 𝘑𝘰𝘶𝘳𝘯𝘢𝘭 𝘰𝘧 𝘐𝘯𝘵𝘦𝘳𝘯𝘢𝘵𝘪𝘰𝘯𝘢𝘭 𝘢𝘯𝘥 𝘊𝘰𝘮𝘱𝘢𝘳𝘢𝘵𝘪𝘷𝘦 𝘓𝘢𝘸.

Abstract: The article combines three fascinating stories: the history of Shanghai with a special focus on the 1930s, the history of the German Civil Code, i.e. a piece of law which has served as model for the private law codifications of many other jurisdictions, and the tragic story of Jury Himmelschein, a very talented Jewish legal scholar. Himmelschein had famously discovered a major flaw in German private law doctrine. In 1933 he left Germany for Shanghai when the N***s came to power. In 1937 he made the fatal decision to return to Europe with terrible consequences.
