On 9 September 2026, CUHK LAW and the Hong Kong Bar Association co-hosted an international symposium, “𝙅𝙪𝙧𝙮 𝙤𝙣 𝙏𝙧𝙞𝙖𝙡: 𝘾𝙧𝙞𝙩𝙞𝙘𝙖𝙡 𝙋𝙚𝙧𝙨𝙥𝙚𝙘𝙩𝙞𝙫𝙚𝙨 𝙤𝙣 𝙩𝙝𝙚 𝙁𝙪𝙩𝙪𝙧𝙚 𝙤𝙛 𝙇𝙖𝙮 𝘿𝙚𝙘𝙞𝙨𝙞𝙤𝙣-𝙈𝙖𝙠𝙞𝙣𝙜” in celebration of the 20th Anniversary of CUHK LAW. Bringing together international judges, leading practitioners, academics and students, the Symposium explored the future of jury trials and lay decision-making across common law and civil law jurisdictions.

𝗞𝗲𝘆 𝗧𝗮𝗸𝗲𝗮𝘄𝗮𝘆𝘀 & 𝗣𝗲𝗿𝘀𝗽𝗲𝗰𝘁𝗶𝘃𝗲𝘀:
⚖️Prof. Jeremy Dein KC and Prof. Luke Marsh of CUHK LAW emphasised that, in setting out the objectives of the event, rather than seeking to defend or reject jury trial in the abstract, the Symposium sought to examine lay decision-making through a rigorous comparative lens.

⚖️Mr José-Antonio Maurellet SC, Chairman of the Hong Kong Bar Association, highlighted in his welcome remarks the constitutional and historical significance of jury trials in Hong Kong, noting that the system is deeply rooted in the common law tradition and safeguarded by the Basic Law. He described jury trials as “the architecture of a mature legal order”, where judges determine questions of law while juries represent the community in deciding questions of fact.

⚖️The Hon. Mr. Justice Kevin Zervos JA, Justice of Appeal, reflected on the operation of Hong Kong's jury system in both legal principle and judicial practice, while His Honour Judge Richard Marks KC, Common Serjeant of London, Central Criminal Court (Old Bailey) examined the tension between preserving traditional jury trials and addressing contemporary demands on the justice system.

This seminar will explore the increasingly important interaction between international arbitration and insolvency proceedings, examining how courts, tribunals and officeholders navigate competing legal frameworks in cross-border disputes. Topics include the effect of insolvency proceedings on arbitration agreements and ongoing arbitrations, the enforcement of arbitral awards against insolvent entities, jurisdictional tensions between arbitral tribunals and insolvency courts, and emerging trends across leading arbitration and insolvency jurisdictions.

The 10th Asian Privacy Scholars Network (APSN) Conference will be held at CUHK LAW from 𝟮𝟯 𝘁𝗼 𝟮𝟱 𝗦𝗲𝗽𝘁𝗲𝗺𝗯𝗲𝗿 𝟮𝟬𝟮𝟲. This year's theme is “Privacy and Data Protection in the Age of Intelligent Systems”.

The Conference will begin with a Young Privacy Scholars Colloquium on 23 September 2026, followed by two days of presentations and discussions by established scholars and practitioners in the field. Prof. Martin Jarrett has published an article entitled “The International Legal Validity of Investor Obligations in Investment Treaties” in 𝘛𝘩𝘦 𝘑𝘰𝘶𝘳𝘯𝘢𝘭 𝘰𝘧 𝘞𝘰𝘳𝘭𝘥 𝘐𝘯𝘷𝘦𝘴𝘵𝘮𝘦𝘯𝘵 & 𝘛𝘳𝘢𝘥𝘦.

About the article: In an effort to counteract the asymmetry of international investment law, some recently concluded investment treaties have included ‘investor obligations’. As their name suggests, they are treaty provisions that impose obligations on investors; for example, to conduct their investment activities in accordance with specified environmental standards. They are also juridically independent, meaning that States could use them to directly sue investors for their misconduct.

Investor obligations are doctrinally fascinating. For one, their subjects are individuals, which challenges the doctrine that individuals are not capable of assuming treaty obligations. If treaty obligations may be imposed on investors, are there any limitations on this power? Finally, considering that investors are not parties to investment treaties, can they take advantage of the pacta tertiis rule and make the operation of investor obligations subject to their consent? This paper analyses these questions.

The jury has long occupied a distinctive position in common law criminal justice. It is not merely a mode of fact-finding. It is also a constitutional, democratic, and symbolic institution through which ordinary citizens participate directly in the administration of criminal justice.

Co-organised by CUHK LAW and Hong Kong Bar Association, the Symposium brings together international judicial, practitioner, academic and juror perspectives to identify what forms of lay participation continue to contribute to legitimacy, fairness, and public confidence in criminal adjudication, and where alternative models of decision-making might better serve contemporary criminal justice.
